Terms of Service – XPcollect Singles & Bulk Buying Program

These Terms of Service ("Terms") govern all card submissions made to Elite Poke Tribe LLC, doing business as XPcollect ("XPcollect," "we," "us," or "our"). By submitting Pokémon cards to XPcollect through any method, you agree to be bound by these Terms.

If you do not agree, do not submit cards to XPcollect.

1. Eligibility

All customers and submitters must be 18 years of age or older. By submitting cards, you represent and warrant that you meet this requirement and have legal authority to enter into this agreement.

2. What We Buy

XPcollect purchases:

  • Raw, ungraded Pokémon singles

  • Pokémon bulk singles

We purchase approximately 98% of submitted cards. In rare cases, certain cards may be declined at our discretion on a case‑by‑case basis.

XPcollect does not purchase graded cards, sealed product, accessories, or non‑Pokémon cards unless explicitly stated in writing.

3. Submission Systems

XPcollect operates two distinct submission systems:

3.1 Singles Submission System (High‑End Cards)

  • Submitted through our online singles buying web application

  • Provides instant offer ranges for customer reference

  • Subject to expert review upon receipt

  • Minimum submission value: $50 USD

3.2 Bulk Submission System

  • Submitted using our bulk submission form

  • No approval required prior to shipping

  • No quantity limits

  • No minimum submission value

Customers acknowledge that shipping bulk cards carries a cost and should submit sufficient value to justify shipping expenses.

3.3 Complete Submissions Required

All submissions must be sent in full. Partial submissions are not accepted or processed.

4. Authenticity & Condition Review

4.1 Authenticity

All cards are reviewed for authenticity by XPcollect experts.

If counterfeit or altered cards are identified:

  • The customer will be notified

  • The cards will be returned to the customer

  • Return shipping is paid by the customer

4.2 Condition Determination

XPcollect makes the final determination of card condition.

If our assessment differs from the customer’s declared condition:

  • We will notify the customer of the revised condition and adjusted price

  • The customer may accept or decline the revised offer

  • If declined, the card(s) will be returned at the customer’s expense

5. Pricing & Offer Acceptance

5.1 Offer Lock Policy

An offer becomes locked when:

  • The customer accepts the offer and

  • Provides a valid tracking number or uses an XPcollect discounted shipping label

5.2 Market Changes

If the customer ships within 48 hours of acceptance, the offer remains locked regardless of market fluctuations.

5.3 Submission Accuracy

All shipments are recorded on video end‑to‑end during intake.

If shipment contents differ from the submission details, XPcollect reserves the right to adjust or void the offer based on verified intake footage.

6. Payment Terms

6.1 Payment Methods

XPcollect currently pays via:

  • PayPal

  • Zelle

6.2 Payout Timing

Payment is issued within 24 hours after content review and acceptance.

6.3 Minimums

  • Singles submissions: $50 minimum

  • Bulk submissions: no minimum

7. Ownership Transfer & No‑Return Policy

Once a submission is received and verified to match the customer’s submission description:

  • Ownership of the cards immediately transfers to XPcollect

  • The payout becomes secured and pending release

No Returns

All submitted cards are final sale and non‑returnable by either party except in cases of verified submission errors.

Return requests are not accepted once a valid submission is confirmed.

Return Shipping Fees

If a return is required due to an error:

  • Shipping and handling costs are assigned case‑by‑case to either XPcollect or the customer depending on fault

8. Packaging & Damage Responsibility

8.1 Packaging Responsibility

Customers are solely responsible for properly packaging all shipments.

Required standards are outlined on our Packaging Guide page and must be followed.

8.2 Damage in Transit

  • Damage caused by improper customer packaging is the customer’s responsibility

  • Damage occurring despite proper packaging is XPcollect’s responsibility

XPcollect may require proof of proper packaging before accepting responsibility.

9. Lost Packages & Insurance Coverage

9.1 Shipments Using XPcollect Labels

  • XPcollect files all carrier insurance claims

  • Our collectibles insurance policy applies

9.2 Shipments Using Customer Labels

  • The customer bears full responsibility

  • XPcollect does not file claims or provide assistance

9.3 Shipments From XPcollect to Customer

If a card is lost while shipping from XPcollect to the customer, XPcollect assumes full responsibility.

9.4 Collectibles Insurance

Our collectibles insurance applies to cards:

  • In transit to or from XPcollect

  • When shipped using XPcollect secured labels

Coverage terms:

  • No value caps

  • Market value determined at time of in‑transit status

  • Subject to carrier confirmation and insurer approval

9.5 Signature Requirements

  • All customer submissions are delivered to our monitored PO Box facility

  • Signature confirmation is required for high‑value returns from XPcollect

10. Intake Verification & Disputes

10.1 Intake Recording

All packages are recorded on video during the full intake process.

10.2 Dispute Process

If a customer believes cards are missing or miscounted:

  • XPcollect provides the intake video

  • Review is conducted based solely on this footage

10.3 Dispute Window

Customers must request investigation within 48 hours of receiving their intake video.

Requests after this period are not accepted.

11. Fraud & Abuse

XPcollect reserves the right to:

  • Refuse service

  • Cancel submissions

  • Withhold payments

  • Permanently ban accounts

in cases of fraud, abuse, misrepresentation, or manipulation of submissions.

12. Limitation of Liability

To the maximum extent permitted by law:

  • XPcollect is not liable for indirect, incidental, or consequential damages

  • XPcollect’s total liability is limited to the amount owed to the customer for the specific submission

13. Arbitration & Governing Law

All disputes shall be resolved through binding arbitration in the State of New Jersey.

These Terms are governed by the laws of the State of New Jersey.

Class actions are waived to the fullest extent permitted by law.

15. Modifications

XPcollect may modify these Terms at any time. Continued submissions constitute acceptance of the updated Terms.

By submitting cards to XPcollect, you acknowledge that you have read, understood, and agreed to these Terms of Service.
